# B4 — Poland primary legal/regulatory sources: what the captured corpus establishes

## Scope and status

Six official Polish statutory documents were captured locally from the Sejm ELI API on 2026-07-30 and read for four questions only:

- **A.** contract / employment classification
- **B.** the employment-agency registration boundary
- **C.** personal and verification data
- **D.** statutory category boundaries for child care, elder care, and pet care

**This is evidence collection, not legal advice.** It is not a compliance assessment, not an opinion on what any product must do, and not a survey of Polish law. It reports what these six documents say, on their face, as captured. Anything the corpus does not show is marked **not established** rather than filled in from memory. No niche is selected and no product is recommended here.

## Method

- Source of record: `api.sejm.gov.pl` (Sejm ELI API), unauthenticated `curl`, no cookies, no login.
- Retrieval log: `reports/evidence/B4-raw/REQUESTS.tsv` (7 HTTP requests, 6 source documents).
- Per-source receipts carry the HTTP headers, byte counts, sha256 of the body, and the verbatim excerpts: `reports/evidence/B4-raw/B4-S1-receipt.md` through `B4-S6-receipt.md`.
- Quotations below are verbatim Polish as transcribed in those receipts. English glosses are glosses, not translations of record.
- None of the HTML responses served a `<title>` element and the PDF has no HTML title, so the recorded document heading (`<h1>` or masthead) is used throughout. No title was invented.

### The S2 HTML response: a failed alternate representation, not a seventh source

Two URLs were requested for the same act (Dz.U. 2025 poz. 620). The HTML endpoint, https://api.sejm.gov.pl/eli/acts/DU/2025/620/text.html (final URL identical, 0 redirects), returned status `200` with `Content-Type: text/html;charset=utf-8`, `Content-Length: 0`, and a zero-byte body, accessed 2026-07-30T17:02:15Z. Receipt: `reports/evidence/B4-raw/B4-S2-receipt.md`, "Request A"; the empty body is retained on disk as `S2-body.raw` (0 bytes).

The request succeeded at the transport level and yielded nothing: the API has no HTML rendering of
this act. From that response alone, the recorded title is **not established**, the source date is
**not established**, and no excerpt could be obtained.

The PDF endpoint returned the same act in full and is the representation used in section B. So this
is **one source document captured in two representations, one of which failed**, not two sources.
The corpus is six documents. The failed capture is preserved rather than deleted so the count stays
honest and the gap stays visible.

## Currentness: read before relying on any quotation below

Every capture is the **text as announced** at the stated Dz.U. position, not a consolidated text
(*tekst jednolity*). Per the receipts:

- **S6 (Kodeks pracy) is materially superseded and must not be read as current law.** The receipt records that Art. 22 § 1 as served reads `na rzecz zakładu pracy` (the pre-reform *zakład pracy* construction), that probes for `pracodawcy i pod jego kierownictwem` return zero hits, and that the served Art. 22 runs § 1 → § 2 → § 3 with no § 1¹ and no § 1².
- **S3 is the 2016 original.** The served `<h1>` ends at `...na tle seksualnym` and does not carry the longer title form including `i ochronie małoletnich`; probes for `ochronie małoletnich` and `standardy ochrony małoletnich` return zero hits. Later expansion of the duty is not in this capture.
- **S1, S4, S5** are as-announced texts from 2011, 2004 and 1997. The S4 and S5 receipts state their acts have been amended repeatedly and that none of those amendments are reflected.
- **S2** is the text as announced on 12 May 2025. Its receipt notes that because the act is recent, the as-announced text is close to current; nothing beyond the 2026-07-30 capture is claimed. The document states its own entry into force: `Art. 461. Ustawa wchodzi w życie pierwszego dnia miesiąca następującego po upływie 14 dni od dnia ogłoszenia,`.

Bundle note: the S1, S4 and S5 receipts cross-reference a `README.md` §"Known limitations". No
`README.md` exists in `reports/evidence/B4-raw/`, so that pointer resolves to nothing in this corpus.

## A. Contract / employment classification

**Established: the *niania* contract is a civil-law services contract governed by the mandate rules.**
S1, Art. 50 ust. 1 (https://api.sejm.gov.pl/eli/acts/DU/2011/235/text.html, accessed 2026-07-30,
receipt `reports/evidence/B4-raw/B4-S1-receipt.md`):

> Art. 50. 1. Nianią jest osoba fizyczna sprawująca opiekę nad dziećmi na podstawie umowy o świadczenie usług, do której zgodnie z przepisami Kodeksu cywilnego stosuje się przepisy dotyczące zlecenia, zwanej dalej „umową uaktywniającą”.

Gloss: a *niania* is a natural person providing care for children under a services contract to which
the Civil Code's mandate (*zlecenie*) provisions apply; that contract is named the *umowa
uaktywniająca*.

**Established: parties and required form.** S1, Art. 50 ust. 3 (same URL, receipt, access date):

> 3. Umowa uaktywniająca jest zawierana w formie pisemnej między nianią a rodzicami albo rodzicem samotnie wychowującym dziecko.

Gloss: it is concluded in **written form**, between the *niania* and the **parents** (or a lone
parent raising the child). The captured provision names only those parties. No intermediary,
agency, or platform appears in it.

**Not established: any employee-versus-contractor test.** The S6 capture states the employment
relationship at the 1974 baseline (https://api.sejm.gov.pl/eli/acts/DU/1974/141/text.html, accessed
2026-07-30, receipt `reports/evidence/B4-raw/B4-S6-receipt.md`):

> Art. 22. § 1. Przez nawiązanie stosunku pracy pracownik zobowiązuje się do wykonywania pracy określonego rodzaju na rzecz zakładu pracy, a zakład do zatrudniania pracownika za wynagrodzeniem.

The receipt states that the provision barring replacement of an employment contract by a civil-law
contract performed under employment-like conditions (inserted into Art. 22 by later amendment) is
**absent from this capture**, and that the current consolidated Kodeks pracy sits at a different
Dz.U. position which was **not fetched** (six-source cap). The receipt calls this "the largest
single gap in the B4 bundle". Accordingly the boundary between an employment relationship and a
civil-law care contract is **not established** by this corpus, at 1974 wording or current wording.

## B. Employment-agency registration boundary

**Established: which activities are regulated and require entry in the register of employment
agencies.** S2, Art. 305 ust. 1 and ust. 2
(https://api.sejm.gov.pl/eli/acts/DU/2025/620/text.pdf, accessed 2026-07-30, receipt
`reports/evidence/B4-raw/B4-S2-receipt.md`; located at `S2-body.txt` lines 6308–6321):

> Art. 305. 1. Agencjami zatrudnienia są podmioty wpisane do rejestru agencji zatrudnienia, świadczące usługi w zakre-sie pośrednictwa pracy oraz pracy tymczasowej.

> 2. Prowadzenie działalności gospodarczej w zakresie: 1) pośrednictwa pracy, które obejmuje usługi wskazane w art. 81 ust. 2, oraz: […] c) gromadzenie i udostępnianie informacji o wolnych i poszukiwanych miejscach pracy za pośrednictwem systemów teleinformatycznych, 2) pracy tymczasowej […] – jest działalnością regulowaną w rozumieniu ustawy z dnia 6 marca 2018 r. – Prawo przedsiębiorców i wymaga wpisu do rejestru agencji zatrudnienia.

Gloss: employment agencies are entities entered in the register of employment agencies which supply
job-placement (*pośrednictwo pracy*) and temporary-work services. Conducting business activity in
job-placement, which under point 1(c) includes **collecting and making available information about
vacancies and job-seekers through ICT systems**, or in temporary work, is **regulated activity**
under the Entrepreneurs' Law and **requires entry in the register of employment agencies**.

Two limits on what that establishes:

- The hyphenation `w zakre-sie` is an artefact of the PDF's fixed layout, reproduced rather than silently repaired; the ellipses are elisions of sub-points 1(a), 1(b) and the tail of point 2, all quoted in full in the receipt.
- The captured text says `rejestr agencji zatrudnienia`. The acronym **KRAZ does not appear in the captured excerpt**. Art. 305 as captured gives a definition and a regulated-activity rule; whether any specific matching, listing, or booking design falls inside it is **not established** here.

## C. Personal and verification data

**Established: a pre-engagement duty to check the restricted-access register.** S3, Art. 21 ust. 1
(https://api.sejm.gov.pl/eli/acts/DU/2016/862/text.html, accessed 2026-07-30, receipt
`reports/evidence/B4-raw/B4-S3-receipt.md`):

> Art. 21. 1. Przed nawiązaniem z osobą stosunku pracy lub przed dopuszczeniem osoby do innej działalności związanej z wychowaniem, edukacją, wypoczynkiem, leczeniem małoletnich lub z opieką nad nimi pracodawcy lub inni organizatorzy w zakresie takiej działalności są obowiązani do uzyskania informacji, czy dane tej osoby są zamieszczone w Rejestrze z dostępem ograniczonym.

Gloss: before entering an employment relationship with a person, **or before admitting a person to
other activity connected with the upbringing, education, recreation, medical treatment of, or care
for minors**, employers **or other organisers** of such activity must obtain information on whether
that person's data appear in the *Rejestr z dostępem ograniczonym* (restricted-access register). In
the captured wording the duty-holder is the employer **or organiser**, and the trigger includes
admission to activity, not hiring alone.

**Established: an explicit carve-out.** S3, Art. 21 ust. 2 (same URL, receipt, access date):

> 2. Wykonanie obowiązku, o którym mowa w ust. 1, nie jest wymagane przed dopuszczeniem do działalności, o której mowa w ust. 1, rodziny małoletniego lub osoby znanej rodzicom małoletniego osobiście i wykonywanej w stosunku do własnych małoletnich dzieci lub małoletnich dzieci znajomych.

Gloss: the check is **not required** before admitting a member of the minor's family, or a person
**known personally to the minor's parents**, where the activity is performed in relation to one's
own minor children or the minor children of acquaintances.

Art. 21 ust. 3 begins to define "family" for the purposes of ust. 2, but the receipt records it as
truncated mid-word at the extraction boundary (`osoby spokrewnione albo os[…]`). Its full content is
**not established** by this corpus. No other verification, identity, or data-protection instrument
was captured.

## D. Category boundaries: child care, elder care, pet care

**Child care (S1).** The statutory forms of care for children under 3 are enumerated. Art. 2 ust. 1
(https://api.sejm.gov.pl/eli/acts/DU/2011/235/text.html, accessed 2026-07-30, receipt
`reports/evidence/B4-raw/B4-S1-receipt.md`):

> Art. 2. 1. Opieka nad dziećmi w wieku do lat 3 może być organizowana w formie żłobka lub klubu dziecięcego, a także sprawowana przez dziennego opiekuna oraz nianię.

Gloss: care for under-3s may be organised as a *żłobek* (nursery) or *klub dziecięcy*, and provided
by a *dzienny opiekun* (day carer) or a *niania* (nanny). The receipt records the act's structure to
match: `Rozdział 2 - Żłobek i klub dziecięcy`, `Rozdział 4 - Dzienny opiekun`, `Rozdział 6 - Niania`.
The *niania* branch is the one carrying the *umowa uaktywniająca* (section A). Statutory duties
attaching to each of the other three forms are **not established** by the captured excerpts.

**Elder care (S4).** Two separate things appear
(https://api.sejm.gov.pl/eli/acts/DU/2004/593/text.html, accessed 2026-07-30, receipt
`reports/evidence/B4-raw/B4-S4-receipt.md`). First, *usługi opiekuńcze* as a public
social-assistance entitlement, Art. 50 ust. 1:

> Art. 50. 1. Osobie samotnej, która z powodu wieku, choroby lub innych przyczyn wymaga pomocy innych osób, a jest jej pozbawiona, przysługuje pomoc w formie usług opiekuńczych lub specjalistycznych usług opiekuńczych.

Gloss: a person living alone who by reason of age, illness or other causes requires the help of
others and is without it, is entitled to help in the form of care services or specialist care
services; ust. 2 extends this to a person whose family (and non-cohabiting spouse, ascendants,
descendants) cannot provide such help. Second, a permit threshold, Art. 67 ust. 1:

> Art. 67. 1. Działalność gospodarcza w zakresie prowadzenia placówki zapewniającej całodobową opiekę osobom niepełnosprawnym, przewlekle chorym lub osobom w podeszłym wieku może być prowadzona po uzyskaniu zezwolenia wojewody.

Gloss: business activity consisting in **running a facility providing round-the-clock care** to
disabled, chronically ill, or elderly persons may be conducted **after obtaining a voivode's
permit**. As captured, the threshold attaches to running such a *placówka*. Article numbering and
thresholds are the 2004 baseline per the receipt, and any requirement attaching to non-residential,
visiting, or hourly private elder care is **not established** by these excerpts.

**Pet care (S5).** The capture establishes a welfare duty, not a market-entry rule
(https://api.sejm.gov.pl/eli/acts/DU/1997/724/text.html, accessed 2026-07-30, receipt
`reports/evidence/B4-raw/B4-S5-receipt.md`). Art. 4 pkt 2 fixes what care of an animal entails:

> 2) humanitarnym traktowaniu zwierząt - rozumie się przez to traktowanie uwzględniające potrzeby zwierzęcia i zapewniające mu opiekę i ochronę,

Art. 9 ust. 1 states the operative duty of whoever keeps a domestic animal:

> Art. 9. 1. Kto utrzymuje zwierzę domowe, ma obowiązek zapewnić mu pomieszczenie chroniące je przed zimnem, upałami i opadami atmosferycznymi, z dostępem do światła dziennego, umożliwiające swobodną zmianę pozycji ciała, odpowiednią karmę i stały dostęp do wody.

Gloss: shelter against cold, heat and precipitation, daylight access, freedom to change body
position, appropriate food, and constant access to water; ust. 2 adds that a tether must not cause
injury or suffering and must permit necessary movement. The receipt states expressly that **no
registration or permit threshold for commercial pet-sitting or boarding was located** in the
captured text, so any licensing boundary for paid pet care is **not established** by this corpus.

## Not established by this corpus

None of the following is filled in from model memory. Each is outside what the six captured
documents show.

1. **Current consolidated wording** of S1 (2011), S3 (2016), S4 (2004), S5 (1997), S6 (1974). All are texts as announced; amendments are not reflected. S6 is expressly superseded.
2. **Any employee-versus-contractor test.** S6 lacks the anti-substitution provision; the consolidated Kodeks pracy was not fetched.
3. **Whether a care platform must enter the employment-agency register for a given product flow.** S2 Art. 305 states a definition and a regulated-activity rule only; the acronym KRAZ is absent from the captured excerpt.
4. **Any register-access mechanics**: who may query the *Rejestr z dostępem ograniczonym* or the full KRK, by what procedure, at what fee, with what retention. S3 Art. 21 ust. 1 establishes a duty to obtain information, nothing further.
5. **GDPR / RODO lawful basis, retention, security, or platform duties.** No data-protection instrument is in this corpus.
6. **The full content of S3 Art. 21 ust. 3** (definition of "family"), truncated at the capture boundary.
7. **Licensing for commercial pet-sitting or boarding.** Not located in S5.
8. **Carer qualification requirements** in elder care. S4's excerpts cover an entitlement and a facility permit only.
9. **Duties attaching to *żłobek*, *klub dziecięcy*, or *dzienny opiekun*** beyond their enumeration in S1 Art. 2 ust. 1.
10. **Any HTML rendering of the S2 act** (that endpoint returned a zero-byte body), and anything about any of these acts after the 2026-07-30 access date.

## Evidence boundary

This file is an evidence summary of six official statutory texts captured on 2026-07-30. **It is
evidence collection, not legal advice**, not a compliance opinion, and not a determination of what
any product may or must do. Several captures are outdated on their face and the Kodeks pracy
capture is superseded; both are reported here to record what the corpus does and does not contain.
